§ 16-1. Definition.

  • For the purpose of this chapter, a subdivision of land is:

    (1)

    The division of land into two (2) or more lots, tracts, sites or parcels of three (3) acres or less in area, or

    (2)

    Resubdivision of land heretofore divided or platted into lots, sites, or parcels.

    Any sales or contract of sale or agreement to purchase any lot or division of land either by lot description or by metes and bounds as defined in the preceding portion of this section shall constitute a subdivision of land and require, prior to any sale or contract of sale or agreement to purchase and before the delivery of a deed, the submission of a plat to, and the approval thereof by the planning and zoning commission.
