§ 2-250. Enforcement request by residents.

  • Any resident of the city or parish may file a written request with the commission on governmental ethics that the commission commence action for injunctive relief to enjoin or to compel compliance with the provisions of this article or for the collection of civil penalties. The request shall state the grounds for belief that a cause of action exists. The commission shall respond no later than thirty (30) days after the receipt of the request, indicating whether it intends to file a civil action. If the response is affirmative and suit is commenced within thirty (30) days thereafter, no other action may be brought unless the action brought by the commission is dismissed without prejudice. If the commission fails to reply or to take any action, the resident may proceed with the action in the same manner and to the same extent as is provided for civil actions by the commission pursuant to section 2-249.
