§ 4-31. Distance restriction.

  • (a)

    The city council shall reject any application for permit, and refuse to issue such permit and the license to any person proposing a place of business to sell, offer for sale or possess for sale spirituous, vinous and malt liquors of an alcohol content of more than one-half of one percent, within three hundred (300) feet of any church, synagogue, school or public library, public playground, full time day care center or correctional facility housing inmates including but not limited to a halfway house and to provide for measurement of this distance.

    (b)

    The distance shall be measured as a person walks using the sidewalk from the main entry door of the church, synagogue, public library, public playground, school, full time day care center or correctional facility housing inmates including but not limited to a halfway house to the main entry door of the premises to be licensed.
