§ 11-2. Controlled burning of condemned properties.

  • (a)

    The fire department is hereby granted authority to burn certain condemned properties within the city limits, and the department of public works is hereby designated to clean up the remaining debris from such controlled burning of properties.

    (b)

    The following terms, conditions and collection fees for such service shall be followed:

    (1)

    The fire chief or his designee shall be the sole authority as to the feasibility of the property to be burned.

    (2)

    After all factors are considered, especially the disposition of adjacent property, overhead power lines, telephone lines and cablevision, etc., the fire chief or his designee shall determine if property can be safely burned.

    (3)

    A fee shall then be set taking into consideration time, manpower and equipment needed to successfully complete the burn and cleanup of remaining debris. This fee shall be no less than two hundred dollars ($200.00).

    (4)

    A release agreement must be duly signed by the property owner/owners releasing the city from any liability which may occur especially to, but not limited to, trees, shrubbery and etc.

    (5)

    The property owner/owners may elect to clean up remaining debris themselves or to have the public works department do it for them, such fee to be based on this determination.

    (6)

    Collection of fees generated on the part of the fire department shall be placed in a separate account which is to be used for the purchase of fire department equipment and/or supplies. The fire chief or his designee shall be the sole authority as to how and where funds are to be disbursed. The collection of fees generated on the part of the public works department shall be placed in the general fund.
