§ 16-137. Obligations of subdivider.

  • (a)

    Any subdivider who subdivides any property within the city and files an application with the planning and zoning commission and the city council, or either of them, for approval of any plat or plats of any such property so subdivided shall be required to state in his application that the subdivider offers and agrees to:

    (1)

    Cut the right-of-way;

    (2)

    Build and prepare the bases;

    (3)

    Hardsurface or blacktop all of the streets located, or to be located, in the area being so subdivided; and

    (4)

    Provide the necessary and proper drainage therein.

    (b)

    All improvements shall be made as reflected by the plat of the land subdivided or being subdivided, within a period of eighteen (18) months after the streets so dedicated as such shall have been actually opened to public use by the city, provided that all such construction of streets is to comply with the specifications and be under the supervision of the department of streets and parks.
